Terms of Service

1. Acceptance & Eligibility

By accessing or using Eternal Bonds ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

Eligibility: You must be at least 13 years old to use this Service. Users between 13 and 17 should have parental consent. By using Eternal Bonds, you confirm you meet this requirement and have authority to enter these Terms.

Account: You may access certain features through Replit authentication. You are responsible for maintaining the security of your account credentials and for all activities under your account.

2. Description of Service

Eternal Bonds is an entertainment application featuring AI-powered character interactions, virtual currency systems, and gacha-style gameplay mechanics. The Service is provided for entertainment purposes only.

3. Virtual Currency & Rewards

Soul Fragments and other virtual items in Eternal Bonds:

• Have no real-world monetary value and cannot be exchanged for cash, credit, or any other form of currency
• Are non-transferable between accounts
• Are non-refundable once acquired, whether purchased or earned
• May be modified, adjusted, or revoked at our sole discretion for balancing, abuse prevention, or service updates
• Do not constitute property and confer no ownership rights

Promotional Rewards & Compensation: Patch compensation, returning player bonuses, and other promotional rewards are subject to eligibility requirements, expiration dates, and may be modified or discontinued without notice.

4. AI-Generated Content

Eternal Bonds uses artificial intelligence services (including but not limited to Anthropic Claude, xAI Grok, and ElevenLabs) to generate character dialogue and voice content.

You acknowledge that:

• AI-generated content is fictional and for entertainment only
• AI responses may be unpredictable, inconsistent, or inappropriate despite our safety measures
• Character personalities and dialogue do not constitute professional advice of any kind (medical, psychological, financial, legal, or otherwise)
• You should not rely on AI characters for guidance on real-world decisions
• AI characters are not real people and do not have genuine emotions, relationships, or intentions

5. Mental Health & Safety Disclaimer

While we implement safety detection systems that may identify concerning content and provide crisis resources, these systems:

• Are not clinically validated or medically approved
• May fail to detect genuine crisis situations
• May produce false positives that do not reflect actual risk
• Should not be relied upon for safety or intervention

If you or someone you know is in crisis: Contact emergency services (911), the 988 Suicide & Crisis Lifeline, or a qualified mental health professional immediately. Do not rely on this application for crisis support.

We log safety incidents for service improvement and may take action on accounts that repeatedly trigger safety systems, including session locks or account restrictions.

6. Payments & Subscriptions

When payment features are enabled:

• Soul Pass subscriptions are billed monthly and auto-renew until cancelled
• Fragment bundle purchases are one-time transactions
• All purchases are final and non-refundable except where required by law
• You are responsible for any applicable taxes on purchases
• Prices may change with reasonable notice
• Chargebacks or payment disputes may result in account suspension

Payment processing is handled by Stripe. Your payment information is subject to Stripe's terms of service and privacy policy.

7. User Conduct

You agree not to:

• Use the Service for any illegal purpose
• Attempt to exploit, manipulate, or abuse virtual currency systems
• Create multiple accounts to circumvent restrictions or farm rewards
• Harass, abuse, or attempt to extract harmful content from AI systems
• Reverse engineer, decompile, or attempt to extract source code
• Use automated tools, bots, or scripts to interact with the Service
• Resell, trade, or commercially exploit any aspect of the Service

Violation may result in account suspension, termination, and forfeiture of all virtual items.

8. Data & Privacy

We collect and process data as described in our Privacy Policy. Key points:

• Conversation logs are stored to enable character memory and relationship features
• Behavioral telemetry (typing patterns, session timing) is processed client-side only; raw biometric data never leaves your device
• Safety incident logs may be retained for service improvement and legal compliance
• We use cookies and local storage for session management and preferences

9. Intellectual Property

All content, characters, artwork, code, and materials in Eternal Bonds are owned by us or our licensors and protected by copyright, trademark, and other laws. You receive a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial entertainment.

Any feedback, suggestions, or ideas you provide may be used by us without compensation or attribution.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components. AI-generated content may contain errors, inappropriate material, or unexpected outputs.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claims shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

Specifically, we are not liable for:

• Any harm resulting from reliance on AI-generated content
• Failure of safety detection systems to identify or prevent crisis situations
• Loss of virtual currency, items, or progress due to technical issues or policy enforcement
• Emotional distress from character interactions or gameplay mechanics

12. Modifications & Termination

We may modify these Terms at any time. Continued use after changes constitutes acceptance. We may suspend or terminate your access at any time, with or without cause, with or without notice.

Upon termination, your license ends immediately, and we may delete your account data, including all virtual items and progress, without liability.

13. Governing Law & Disputes

These Terms are governed by the laws of the State of California, USA, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in San Francisco, California, except where prohibited by law.

You waive any right to participate in class action lawsuits or class-wide arbitration.
